2008-2011 Recent Settlements

$150,000.00 for a deputy sheriff who tripped on an un-level elevator and required surgery for a torn meniscus in his knee. He quickly returned to work after the surgery.

Five Million ($5,000,000.00) DOLLAR wrongful death settlement for family of deceased operating engineer who fell 40 stories to his death when catwalk collapsed during construction of building leaving wife and three minor children. Creative capital worked out structures assuring family and children will be financially stable for the rest of their lives.
ONE HUNDRED FIFTY THOUSAND ($150,000.00) DOLLAR settlement for injured UPS worker who tripped on rug placed upon top of carpet while delivering packages to office in Suffolk County who underwent knee surgery.

Two Hundred Forty Seven Five Hundred Thousand ($247,500.00) DOLLAR recovery of head on collision in New Jersey where driver had a one hundred thousand dollar policy and plaintiff had an additional available $150,000.00 in Supplemental Underinsured motorist coverage for fractured ankle with surgery.

Settlement of $240,000.00 for a Suffolk County bread deliveryman who slipped on ice while delivering bread to a school. He suffered a fracture ankle and is back at work.

Settlement on the eve of jury selection of $1,600,000.00 for a New jersey resident who was struck by a moving fork lift and sustained multiple leg fractures. he is now back working at his job as a teamster, but no longer drives the big rigs.

Settlement of $750,000.00 for a 52 year old delivery person who slipped and fell on water on floor of Mall at 6:00am while making a delivery to ice cream store. The Mall had just been cleaned by Mall employees who failed to post signs or barricades. Injured worker suffered a herniated disc in his neck and required a fusion.

Recovery of $1,600,000.00 for a truck driver who was struck from the rear by a HiLo machine that was backing at a high rate of speed and from which the backup mirrors had been removed at the direction of the owner’s safety director. The employee suffered a fracture of the right ankle, a rupture of the tendon of the left kneecap and multiple wound infections requiring 7 hospitalizations

Recovery of $1,250,000.00 for a window washer who fell from the stairway leading to his window washing machine that was on the roof of the building where he was working when the railing broke causing him to fall 8′ to the roof. He sustained a crush injury to his calf that was surgically repaired. He then suffered from multiple infections of the wound requiring 4 additional surgeries.

Settlement of $550,000.00 for a sheet metal worker who was performing billboard repair work in New York City and whose arm was hyperextended while on a scaffold when the wind blew out the sign that was not properly secured. He sustained herniated discs and a torn rotator cuff of the shoulder but did not undergo any surgical proceedures.

Settlement at jury selection for a 29 year old woman who had two auto accidents within 4 months of each other who sustained neck and right arm injuries. One case settled for $35,000.00 and the other settled for $102,000.00.

Recovery of $350,000.00 for a cement worker who was sitting in the construction van waiting to be escorted across the Triborough Bridge to the work site when a cab and a truck collided and the truck struck the worker’s van that was parked at the curb. The worker had shoulder surgery for the aggravation of a pre-existing rotator cuff tear.

$3 Million Dollar recovery for union construction laborer/bricklayer who received serious injuries as a result of the collapse of the second floor of a building undergoing renovation as he was working below on the first floor. The contractor failed to use any safety equipment to brace the floor slap as it was being cut and failed to clear the area below. Plaintiff underwent numerous surgeries and brain injuries and remains disabled.

$1.75 Million Dollar recovery for a cement and concrete construction worker who was injured when the concrete bar he was bending broke causing him to fall a height on a construction site sustaining disabling back injuries requiring several surgeries and retirement from the construction trades. He was not given any type of fall protection or safety devices.

$1.2 Million Dollar recovery for a construction worker on Long Island who was injured when the ceiling they were demolishing fell collapsing the scaffold they were working on. He required two back surgeries and was unable to return to the construction trades.

$970,000 Thousand Dollar recovery for a fish store worker who received disabling back and neck injuries when the car he was driving on the Cross Island Parkway was struck by a car going in the opposite direction that flipped over the divider striking the plaintiff’s vehicle. He placed his hand in an unguarded meat grinder without a cover and accidentally activated it. He will receive over five million dollars over the course of his life. The manufacturer of the device had long before gone out of business.

$1,1 Million Dollar recovery for a school teacher who was driving east on the Belt Parkway at the Mill Basin Bridge when a westbound car road the median barrier and crossed over the divider striking the plaintiff’s van head on. The car that crossed over the divider had a minimal $25,000.00m policy. Suit was successfully brought against the City of New York for their defective maintenance of the bridge and the guardrail system.

$300,000.00 Dollar settlement for a 19 year old construction worker from New Orleans working in Manhattan when he lost the a portion of the tips of two fingers on his non-dominant hand when his hand was pulled into a table saw while cutting wood for door frames on a job site. He is now back working full time in construction.

2008 Results

$395,000 recovery for a construction worker who received multiple injuries when his scaffold collapsed, causing him to fall to the ground. The case was settled during the presentation of plaintiff’s case before a jury in Queens county.

$95,000 settlement for a woman who was rear ended on the Staten Island Expressway and sustained soft tissue injuries to her neck and minor tear of a shoulder ligament. The case settled after Jeffery A. Manheimer obtained a judgment on liability in the plaintiffs favor.

2007 Results

$1.5 Million Dollar settlement for the widow and minor child of a man who died as a result of a doctor’s failure to diagnose stomach cancer which caused a loss of any chance for a cure.

$950,000.00 Thousand Dollar recovery for a 27 year old ironworker from Bath, New York in the western part of the State who was injured when a crane lost a roof joist that was being lifted during a construction project in Elmira which then fell bouncing off the plaintiff’s thigh while he was sitting on a steel beam. He developed reflex sympathetic dystrophy and is unable to return to iron work. There was a total of one million dollars of insurance coverage available. Plaintiff is now in College in Corning, New York and hopes to return to the labor market in another field.

$850,000.00 Thousand Dollar settlement for a 38 year old aircraft operations employee for Lufthansa residing on Long Island who was pinned between a dolly and a machine used to load cargo into the belly of aircraft when the driver moved the machine forward without warning striking the plaintiff between the knee and the ankle. Plaintiff had multiple fractures and post-operative infections with scarring. Plaintiff was out of work from May until the following January. He has returned to work for Lufthansa.

$300,000.00 Thousand Dollar settlement for a sheet metal worker who was installing a Red Lobster 20 foot sign in Times Square when he was pulled off the steel beam on which he was standing and fell to the ground below. There was no place for him to tie a safety harness on and no other safety devices were given to him. He was in the hospital for two weeks but only lost 6 weeks from work.

$250,000.00 Thousand Dollar settlement for a union electrician who sustained a knee injury requiring two surgeries when a crane lost a load of wood above the 26th floor of a building under construction in New York City. The wood fell to the floor and bounced striking the plaintiff in the knee. He was out of work for four months and is now back working full time as a union electrician.
